The Property Platform: Customer Terms
These terms take effect on 1 November 2026. Until then, and for anything that happened before that date, the terms published on 12 June 2026 apply. They are kept at /legal-policy/2026-06-12.
1. About these terms
These terms are between you and The Property Platform.com.au Pty Ltd (ABN 76 606 716 027) ("TPP", "we", "us"). They apply when you use The Property Platform as a customer (a seller, buyer, landlord or tenant, or someone enquiring about a property) through our websites, apps or sign-in, and when you order products from TPP.
Agencies, agents, Networks and suppliers work with TPP under their own agreements, not these terms.
By creating an account or placing an order, you agree to these terms. Please read them with our Privacy Policy at /TPP_Privacy.
2. What TPP does, and what your agency does
TPP provides software. Where your agency gives you access, your account lets you see information your agency shares with you, see and pay for what you order, and decide what you order.
TPP is not a real estate agency and does not hold a real estate licence. TPP does not appraise your property or give an opinion on its price, market property for sale or lease, negotiate for you, or prepare or sign your agency agreement or contract for you. Your licensed agency does that work under its agreement with you, and is responsible for it. TPP is not a party to your agreement with your agency or to any contract of sale or lease.
TPP does not hold deposits or any other money for you. Deposits are held by the deposit holder named in your contract.
3. Your account
- You must be 18 or over to hold an account.
- Give us accurate details and keep them up to date.
- Keep your sign-in details secure, and tell us at support@thepropertyplatform.com straight away if you think someone else has used your account. We will help you secure it.
4. Products you order
4.1 Before an order is placed, we show whoever places it what the product is, its price including GST, who sells it (TPP, your agency or a supplier) and when payment is due, along with any conditions or cancellation terms that apply to it.
4.2 When TPP sells a product, your contract for it is with TPP. TPP may use suppliers to deliver it, and TPP stays responsible to you for it.
4.3 When your agency or a supplier sells a product, your contract for it is with them, on their terms, and they invoice you. TPP may show that order and invoice in your account, but TPP is not a party to it.
4.4 TPP sells only products that do not need a real estate licence. Anything that needs a licence is provided by your agency.
4.5 Your agency may order products from TPP for you, with your authority, for example for your marketing campaign. TPP then sells them to you on these terms and invoices you.
5. Paying TPP
5.1 You pay TPP's invoices directly to TPP, using the payment methods shown when you order, such as card through our payment provider. Payment is due when you order, unless the invoice says otherwise.
5.2 TPP receives payment only of its own invoices. TPP does not receive, hold or pass on money on your behalf.
5.3 Card details are handled by our payment provider. We do not store full card numbers.
5.4 Your agency's commission is set by your agreement with your agency. From 1 November 2026 your agency invoices and collects it; TPP does not.
6. The changeover on 1 November 2026
6.1 Before 1 November 2026, TPP invoiced some sellers in its own name for their agency's commission and collected it.
6.2 If TPP issued you a commission invoice before 1 November 2026 and it is unpaid on that date, it stays TPP's invoice. Pay it to TPP as the invoice states, and TPP settles with your agency. If it is still unpaid on 31 December 2026, TPP will cancel it and your agency will invoice you for the amount owing.
7. Using the platform properly
You must not:
- use the platform for anything unlawful;
- give false or misleading information;
- try to see information that is not meant for you;
- interfere with the platform's security or operation, or copy or extract its content by automated means;
- act for someone else without their authority.
8. Your information and content
8.1 We handle personal information as our Privacy Policy describes.
8.2 Content you upload, such as documents, photos and messages, stays yours. You allow TPP to store, copy and display it to provide the platform to you and to the people you deal with through it, such as your agency.
8.3 You confirm you have the right to give us anything you upload.
9. AI on the platform
The platform uses AI to help prepare messages, summaries and suggestions, and AI can make mistakes. A person confirms before anything prepared by AI is sent to you, a money figure is changed or a listing is submitted. Nothing AI produces on the platform is legal, financial or valuation advice; for that, ask your agency, your solicitor or a licensed adviser.
10. Your rights under the Australian Consumer Law
10.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights.
10.2 For a major failure with a service, you are entitled to cancel your contract with us and to a refund for the unused part, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure is not a major failure, you are entitled to have it fixed in a reasonable time and, if it is not, to cancel your contract and get a refund for the unused part.
10.3 Subject to 10.1, TPP is not responsible for work done by your agency, by the other party to your transaction, or by a supplier that sells to you directly, or for loss caused by incorrect information they or you entered.
11. Changes to the platform
We work to keep the platform available, but it may sometimes be unavailable, for example for maintenance. We may change features over time, and will give you reasonable notice of any change that materially reduces what you can do.
12. Closing or suspending an account
12.1 You can close your account at any time by emailing support@thepropertyplatform.com. Orders already placed continue unless they are cancelled under their own terms.
12.2 We may suspend or close your account if you seriously breach these terms, if we reasonably suspect fraud or unlawful activity, or to protect the platform's security. We will tell you why, unless the law prevents us.
12.3 Closing an account does not affect amounts already owed or rights already accrued. We keep records as our Privacy Policy describes.
13. Changes to these terms
We may change these terms. We will tell you by email or in your account at least 30 days before a change that is not in your favour takes effect, and you can close your account before it does. The current version and its date are always at this address.
14. Questions and complaints
Email support@thepropertyplatform.com. If your complaint is about work your agency did, raise it with your agency first. You can also contact the fair trading office in your state or territory.
15. General
These terms are governed by the laws of Queensland, and the courts of Queensland have non-exclusive jurisdiction. If any part of these terms is unenforceable, the rest still applies. We may transfer these terms to a buyer of all or part of our business, and will tell you if we do.
