The Property Platform: Privacy Policy

Last updated: 14 October 2026. This version replaces the version of 12 June 2026.

1. Who we are and what this policy covers

The Property Platform.com.au Pty Ltd (ABN 76 606 716 027) ("TPP", "we", "us") runs The Property Platform: software that licensed real estate agencies, their agents and Networks, and the suppliers they work with use to run property sales and the customer relationships around them, and that customers use to see their own property matters. This policy explains how we handle personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

It covers:

  • customers: sellers, buyers, landlords and tenants, and anyone who enquires about a property;
  • partners: agencies, agents, Networks and their staff;
  • suppliers and their staff;
  • anyone who visits our websites or contacts us.

TPP is not a real estate agency. When a licensed agency uses our platform to work with you, that agency also handles your personal information under its own privacy policy, and it is responsible for the licensed work it does for you.

2. Our two platforms

We are moving from our current platform (the legacy platform) to a new platform in stages, finishing in early 2027. Until an agency moves, its records stay on the legacy platform. This policy covers both, and says where they differ.

3. What we collect

  • Identity and contact details: name, email, phone, postal address, role, employer or business, and ABN.
  • Property and transaction details: property addresses and details, listing and campaign details, sale and settlement dates, solicitor or conveyancer details, and the products and services ordered for a property.
  • Financial details: invoices, payments and refunds; commission amounts and how they are split (for partners); bank account details where we pay or are paid. Card payments are taken by our payment provider and we do not store full card numbers.
  • Identity verification: TPP does not hold identity documents or identity records. Where your agency must verify your identity under anti-money-laundering law, it uses a verification provider, which holds them. We may record that a check was completed, and when.
  • Communications: records of calls, text messages, emails and enquiries made through the platform, and conversations with our AI assistant where you use it.
  • Preferences and consent: what you have agreed to receive, and on which channel; and, where our AI assistant keeps them, your working preferences.
  • Technical details: sign-in records, IP address, device and browser details, how you use our websites, and cookies.
  • For partners: licence details, agreements, team and pay rules, and activity records.

We do not ask for sensitive information, such as health information or religious beliefs. If you give us some, we handle it only as the law allows.

4. How we collect it

  • From you, when you create an account, sign in, fill in a form, place an order or contact us.
  • From your agency or agent, who enter details about you to provide their services.
  • From others in your transaction where they need to, such as solicitors, conveyancers, suppliers and the other party's agent.
  • From service providers, such as our payment provider, a verification provider (the result only), and property portals when you enquire through them.
  • From public sources, such as property records and public licensing registers.
  • Automatically, through sign-in records, logs and cookies.

If we receive personal information we did not ask for, we keep it only if we could have collected it ourselves; otherwise we destroy or de-identify it.

5. Why we use it

  • To run the platform and your account, and keep them secure.
  • To let your agency, its agents and the suppliers you deal with provide their services to you.
  • To sell you products you order from us, invoice you, take payment and give refunds.
  • To calculate and report amounts owed between the parties to a transaction, such as commission splits and fees, and to keep our accounts.
  • To send you the service messages you need, and other messages you have agreed to receive.
  • To answer enquiries and complaints and give support.
  • To improve and test the platform. We test with made-up data wherever we can. Where a test needs real records, they stay in systems we control and are deleted when the test ends.
  • To meet our legal obligations, such as tax and record keeping, and to respond to regulators.

We use personal information for another purpose only with your consent or where the law allows.

6. Commission and payments

Until 31 October 2026, on our legacy platform, TPP invoiced sellers in its own name for their agency's commission, collected it, and paid the agency, its agents and Network their shares. To do that we used the sale price, the commission amount, the split between recipients and their bank details. A commission invoice TPP issued before 1 November 2026 and not yet paid is collected by TPP until 31 December 2026.

From 1 November 2026, your agency invoices and collects its own commission. TPP calculates and reports the figures for the agency but does not receive the money. TPP receives payment only of its own invoices, for products and services TPP sells.

We keep records of past transactions for as long as the law requires (section 12).

7. Who we share it with

  • Your agency, its agents and staff, and its Network where it belongs to one, limited to what their role needs.
  • Suppliers delivering something you have ordered.
  • Others in your transaction where needed, such as solicitors, conveyancers and the other party's agent.
  • Our service providers, for hosting, customer records, sign-in, payments, accounting, messaging, e-signing, identity verification, AI tools and support.
  • Our professional advisers, such as lawyers, accountants and auditors.
  • Regulators, courts and law enforcement where the law requires or allows.
  • A buyer of all or part of our business, under confidentiality, and we will tell you if that happens.

8. Where it is stored, including overseas

Our main records are held in Australia:

  • Salesforce, in its Australian data centres, for both platforms;
  • our own services on Amazon Web Services in Sydney, including our AI assistant, which runs on Amazon Bedrock in Sydney and Melbourne;
  • sign-in, through Auth0 in its Australian region;
  • e-signing, through Annature in Sydney.

Some providers store or process personal information overseas, mainly in the United States: card payments (Stripe), text messages (Twilio), accounting (Xero), email and office tools (Google), team messaging (Slack) and the AI tools our staff use (Anthropic). Our websites are delivered through a content delivery network that serves pages from data centres around the world. Our providers' support staff may also see information from other countries.

Before we disclose personal information to a recipient overseas, we take reasonable steps to make sure it handles that information consistently with the Australian Privacy Principles.

9. Decisions made with computer programs

Our platform uses computer programs, including AI, in decisions that can affect you. From 10 December 2026 the law requires us to tell you about this. We are telling you now.

  • Amounts: programs calculate fees, commission splits and amounts invoiced or payable, from the agreement and sale details recorded. They use sale and agreement details and the names and roles of the parties.
  • Access and security: programs may block a sign-in or pause an account when a sign-in looks risky, such as repeated failed attempts or signs of an automated attack. They use sign-in records, IP addresses and device details.
  • Messages: on our new platform, a program checks your consent for a channel before a marketing message is sent, and does not send it without that consent. It uses your contact details and consent records.
  • What you are shown: on our new platform, suppliers and products are shown in an order set by neutral rules, and nothing a supplier pays changes its position. The rules use your property's location and what you have asked for.
  • Identity verification: where your agency verifies your identity through a verification provider, the provider's systems check your details and return a result. Your agency decides what happens next.
  • Drafts and suggestions: our AI assistant drafts messages, summaries and next steps for agents and staff. A person confirms before anything is sent to you, a money figure is changed or a listing is submitted.

If a decision made or helped by a program affects you, you can ask for a person to review it by emailing support@thepropertyplatform.com. We will tell you the outcome.

10. Marketing messages

TPP sends you marketing messages only with your consent. Your agency may also message you through our platform; on our new platform, every marketing message is checked against your consent for that channel first. You can opt out at any time with the unsubscribe link in a message or by emailing support@thepropertyplatform.com.

11. Keeping it secure

We protect personal information with role-based access, encrypted connections, separate test and live systems, access logs and checks on who changed what. No system is completely secure. If a data breach is likely to cause you serious harm, we will tell you and the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme requires.

12. How long we keep it

We keep personal information only as long as we need it for the purposes in this policy or the law requires: financial records, for example, for at least seven years. Then we delete or de-identify it. When we close our legacy platform, we will move the records still needed to the new platform and keep an archive only as long as the law requires. Where our AI assistant keeps working preferences for you, you can see, correct and delete them.

13. Access and correction

You can ask to see the personal information we hold about you, or to correct it, by emailing support@thepropertyplatform.com. We may need to confirm your identity. We do not charge for a request, and we respond within 30 days. If we refuse, we tell you why and how to complain. Where your agency entered the information, we may work with the agency to answer you.

14. Complaints

If you think we have breached the Privacy Act or the Australian Privacy Principles, email support@thepropertyplatform.com. We will respond within 30 days. If you are not satisfied, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
